Our Terms of Service
All items below are in effect unless otherwise agreed upon. Hiring Mikon Haaksman/ Haaksman Media constitutes that you agree to all the terms and conditions below.
GENERAL:
Please notify us immediately if your schedule should change. We are obligated to charge a fee for short-notice cancellations to compensate for lost bookings and lost wages for freelancers.
We require a 50% deposit prior to production to hold the date. Final payment is required 30 days from last contracted day of work.
For first time clients on projects not requiring a deposit, we do require full payment immediately upon delivery of footage.
Any late payments will incur an interest charge after 30 days from invoice issuance at the highest percentage allowed by law, not to exceed 18% per annum.
Not included are craft services (food), courier charges, tape/disc costs and any extras requested by the client not agreed upon or last minute schedule changes and necessary taxes.
Once payment is made in full, the client retains all rights to the final master and its content.
ON SITE PRODUCTION:
Less than 24 hours Cancellation: 100% of the rate quoted.
24 to 48 hours Cancellation: 50% of the rate quoted.
Half Days/Full Days:
A half day is 0-5 hours from crew call time to the completion of wrap.
A full day is 5-10 hours from crew call time to the completion of wrap.
Multiple partial days cannot be combined.
OVERTIME:
Overtime is billed at 1.5 times the regular hourly rate beyond 10 hours. After 12 hours, overtime is billed at 2 times the regular hourly rate. Time begins at the crew call time and ends at the completion of wrap. For shoots outside of Dallas, Tarrant and Collin Counties, start time begins when leaving these Counties and ends when returning to one of these Counties.
MILEAGE:
Mileage will be billed at current IRS mileage rate per vehicle for vehicle travel beyond Dallas, Tarrant and Collin Counties.
TRAVEL TIME BEYOND DESIGNATED CITY:
Travel days within the continental US are billed at 50% for both crew and equipment. Days qualifying as travel days must be either the first and/or last day of a shoot, and may not begin earlier than 3 p.m. on the day before the first production day. Travel time per day may not exceed 5 hours. Travel days between production days on extended shoots, travel days beginning earlier than 3 p.m. on the day before the first production day, and travel days over 5 hours in length are billed at full day rate. Travel time on the same day as production, either before or after working production hours, are counted as regular work hours; regular crew overtime rates will apply for hours after 10.
Not included are all transportation, customary tipping, hotel or car rental costs.
FILE TRANSFER, UPLOAD, COPYRIGHT, USAGE:
Hard drives and transfer/upload costs are not typically included in the initial invoice. Client may provide a hard drive or request Haaksman Media purchase one for transfer. Hard drive is billed at market value on final invoice. Shipping costs incurred are the responsibility of the client. We do our best to offer upload services for smaller shoots and can provide dailies at a nominal cost. Dailies can be uploaded with timecode and in a variety of codecs. Cost is typically $50-$100 for this service. Upload fee is $1 per GB.
Client retains copyright of material shot by Haaksman Media - unless footage is already claimed by another party or is existing stock footage already owned by Haaksman Media or another 3rd party. Haaksman Media may request use of footage for marketing purposes such as demo reels.
